Terms of Service

These Terms of Service (“Terms”) govern your use of riderode.com and related services (the “Service”) operated by RideRode (“RideRode,” “we,” “us”). By creating an account or using the Service you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. What RideRode is, and is not

RideRode is an online classifieds marketplace where people list and find motorcycles, ATVs, side-by-sides, snowmobiles and related vehicles. RideRode is not a dealer, broker, agent or auctioneer and is not a party to any sale. Buyers and sellers deal directly with each other and pay each other directly. We do not inspect vehicles, verify titles, hold money or guarantee that any listing is accurate, legal or available.

2. Your account

• You must be at least 18 and able to form a binding contract.
• You sign in with Google or Facebook. You are responsible for activity on your account and for keeping your sign-in secure.
• Give accurate information and keep it current. One person may not run multiple accounts to evade a suspension or manipulate bidding or reviews.

3. Listings and sellers

• Selling requires a paid seller plan. The number of live listings depends on your plan. Listings expire after the period shown on the site unless renewed or marked sold.
• You must own the vehicle or be authorized to sell it, have the right to sell it, and describe it honestly, including its condition, mileage, title status and known defects. Include accurate photos and a correct VIN or serial number.
• You are responsible for title transfer, taxes, registration, emissions and all other legal requirements of the sale.
• Do not list stolen vehicles, vehicles with altered or missing identification numbers you cannot lawfully sell, items you do not have, counterfeit goods, or anything prohibited by law.
• We may reject, hide or remove any listing, and suspend any account, at our discretion, including for reports of fraud.

4. Auctions are non-binding

Auctions on RideRode are non-binding. A bid or a high bid is an expression of interest and does not create a contract to buy or sell. A sale happens only if the buyer and seller each agree to complete it. Bids cannot be retracted to manipulate prices, and shill bidding is prohibited. Bids placed in the final minutes of an auction extend the closing time as shown on the site.

5. Plans, billing and cancellation

Seller plans are billed monthly to the payment method you provide until you cancel. Prices are shown before you pay. You can cancel at any time; your listings stay up until the end of the period you have already paid for, and we do not give refunds for partial periods unless the law requires it. We may change prices with notice before your next billing date.

6. Promotion on LA Nik’s Facebook page

Seller Plus and Dealer plans may include eligibility to have a listing featured in a post on LA Nik’s Facebook page. Featuring is at our discretion and is not guaranteed. These posts are paid placements and are labeled #ad. LA Nik has not inspected featured vehicles and a feature is not an endorsement.

7. Messages, comments and reviews

• Be honest and civil. Do not harass, threaten, impersonate others, post personal information about other people, or spam.
• You may review a seller only after you have contacted them about a listing, and only about your real experience. Sellers may respond publicly and may dispute a review they believe breaks these rules; we decide those disputes at our discretion.
• Never pay by wire transfer, gift card or a link in a message from someone you have not met, and never send money before you have seen the vehicle and the title. RideRode will never ask you to pay through a link in a message.

8. Your content

You keep ownership of the photos, videos, text and other content you post. You give RideRode a worldwide, non-exclusive, royalty-free license to host, display, reproduce, adapt for formatting and promote that content in connection with operating and promoting the Service (including on social media and in LA Nik’s Facebook posts for eligible listings). You promise you have the rights to grant this license and that your content does not infringe anyone else’s rights.

9. Prohibited conduct

Do not: break the law; commit fraud; interfere with or overload the Service; scrape or copy data at scale; probe for or exploit security weaknesses; bypass fees or limits; or use the Service to send unsolicited bulk messages.

10. Copyright and reporting problems

If you believe content on RideRode infringes your copyright, or you want to report a listing, review or comment, email kenny@entrepreneurialpm.com with the link and details. We may remove content and may end accounts of repeat infringers. Signed-in users can also use the Report button on listings, reviews and comments.

11. Disclaimers

The Service and all listings are provided “as is” and “as available.” To the fullest extent the law allows, RideRode disclaims all warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that listings are accurate, that vehicles are safe or lawfully sellable, that users are who they say they are, or that the Service will be uninterrupted or error-free. Used vehicles carry inherent risks; inspect before you buy.

12. Limitation of liability

To the fullest extent the law allows, RideRode and its owners, employees and partners are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, or for any dispute between users or any loss arising from a transaction between users. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid RideRode in the 12 months before the claim and US$100. Some places do not allow these limits, so they may not apply to you.

13. Indemnity

You agree to defend and reimburse RideRode for claims, losses and costs (including reasonable legal fees) arising from your content, your listings or your violation of these Terms or the law.

14. Suspension and termination

You can stop using the Service and delete your account at any time (see Data Deletion). We may suspend or end your access at any time, including for breaking these Terms. Sections that by their nature should survive termination will survive.

15. Changes

We may update these Terms. We will post the new version and change the date above. If you keep using the Service after a change takes effect, you accept it.

16. Disputes and general terms

These Terms are the entire agreement between you and RideRode about the Service. If any part is unenforceable, the rest stays in effect. Our failure to enforce a right is not a waiver. You may not transfer your rights under these Terms; we may transfer ours in a merger or sale of the business.
